Pair jailed for 15 years on sex charge

Pair jailed for 15 years on sex charge

Feb 01, 2011 - 18:30

ASADABAD (PAN): A primary court in eastern Kunar province sentenced a 50-year-old woman and a 25-year-old boy to 15 years in prison for having sex in a hotel, the judge said on Tuesday.

Police charged the pair, Shakeela and Safdar, of having sex in the Green Hotel in Asadabad a month ago.

Shakeela, who introduced herself as a resident of Kabul's Qarah Bagh district, has been living in eastern Nangahar province, the court's head judge, Muhibullah, told Pajhwok Afghan News.

Prosecutor Mohammad Hashim had sought the maximum punishment for the two under article 427 of the Constitution. On the prosecutor's request, Muhibullah, said the two were sentenced to 15 years each in jail.

The couple’s lawyer, Hasibullah, did not appear in court, but sent his arguments. In his arguments, the lawyer called the court's verdict baseless, saying article 427 does not apply in such a case.

He urged the court to bail the pair out.

Shakeel denied that they had intercourse. She said she visited Asadabad to borrow money from Safdar.

However, the pair had confessed to the charge in the Shariah section of their dossier.
